TERMS & CONDITIONS OF SALE 1. WHO YOU ARE BUYING FROM All tickets purchased from this website are sold by The Museum of Modern Art, 11 West 53rd Street, New York, NY 10019 ("the Museum"). By booking a ticket, you are agreeing to the terms and conditions outlined in MoMA’s agreement. Ingresso is providing and powering the B2B ticketing platform. 2. CUSTOMER DATA Ingresso is responsible for the operation of this website and is the data processor for all personal data collected, including data relating to your purchase of tickets but excluding payment card data (i.e. the sixteen digit card number, expiry date and three digit security code). Ingresso reserves the right to make changes to these policies from time to time to accommodate new technologies, industry practices, regulatory requirements and for any other legitimate and lawful purpose. Ingresso's Privacy Policy can be found here. 3. PRICING All prices are inclusive of taxes and/or fees unless otherwise stated. Tickets may not be sold for less than the price that the Museum charges for general admission to the Museum. 4. REFUNDS/EXCHANGES Tickets can be exchanged or refunded up to 24 hours before the visit. If you need to change details on your ticket order, please contact tourism@moma.org with your booking number. 5. USE OF TICKET You may sell the tickets either individually or as a component of a package. Tickets may be used for self-guided visits only; they cannot be applied to the purchase of private Museum tours. Tickets are not redeemable for cash. 6. ADMISSION At MoMA, we celebrate creativity, openness, tolerance, and generosity. We aim to be an inclusive place—both onsite and online—where diverse cultural, artistic, social, and political positions are welcome. We’re committed to working together to create a safe experience for our team and visitors, and our professionally trained frontline staff are here to help you. We have a zero-tolerance policy for individuals who endanger staff, visitors, artwork, or any Museum property, or who engage in verbal or physical harassment, discriminatory or threatening behavior, or otherwise interfere with the experience of others. The Museum will refuse or revoke admission to individuals who violate these policies. For everyone’s safety, please follow the instructions of security officers. 7. LIABILITY You voluntarily assume all risks and danger incidental to the event for which the ticket is issued, whether occurring prior to, during or after the event. You voluntarily agree that the Museum, Ingresso, and each of their respective parents, affiliates, subsidiaries, agents, officers, directors, owners and employees (collectively, the "Released Parties") are expressly released by you from any claims arising from such causes, other than liability for death or personal injury caused by the Released Parties' negligence. 8. APPLICABLE LAW The Agreement between you and the Museum is the entire understanding between the parties and supersedes and replaces any previous understandings between the parties concerning the subject matter addressed in this Agreement. The Agreement shall be governed by the laws of the State of New York. Any dispute arising hereunder shall be resolved exclusively in the courts located in the State of New York, County of New York.
